A Statement Concerning The Mufti’s Latest Fatwa

Lebanon’s Grand Mufti has issued on Monday the 28th of January a fatwa whose sole aim is to decapitate one of the many marginalized rights the Lebanese citizens are missing. The fatwa came after the latest tactic the civil society adopted which included two couples attempting to register the first civil marriage on Lebanese soil through loopholes in the Lebanese legal system. Sheikh Qabbani’s statement on Dar al-Fatwa’s website; the official institution for fatwas, stated:

Any Muslim with legal or executive authority in Lebanon who supports the legalization of civil marriage is an apostate and outside the religion of Islam. He shall not be bathed, shrouded and prayed upon, nor shall he be buried in the cemeteries of Muslims and shall carry the sins of all the sons and daughters of Islam who enter a relationship as such until the Day of Resurrection.1

What is more alerting is the Mufti’s illustration of the “heroic” Muslim scholars who are standing ready and to perform their duties in battling the civil society (the so-called predator) which is attempting to implant the “germ” of civil marriage within the Lebanese community. In his statement, Qabbani did not hesitate to drag the whole Lebanese Muslim population into his perspective by declaring that it is the obligation and the duty of every Muslim to annul civil marriage and to stand against that right since it targets and threatens the religious institution.

Freethought Lebanon dismisses this fatwa and condemns the statement on all levels. Even though the Mufti is considered to be the representative of the Sunni population in Lebanon, he should recognize that the Lebanese citizens will not be hostages to the perspective of Dar al-Fatwa and its followers, and that his voice represents the opinion of one single entity, and cannot be fallaciously generalized to include all Muslims as he claimed. More than 73,000,000 Turkish citizens (98% of which are Muslims) are forced by law to be married under the Turkish civil law, none of their Muslim leaders ever considered them as apostates.  The civil society’s demand was not the obligatory enforcement of civil personal status laws on the Lebanese public; but a demand from the government to deliver to its citizens the basic right of choice.

Needless to say, the Mufti’s fatwa clashes with the freedom of choice of all Lebanese citizens. Moreover, the severity of the consequences for those who diverge from the fatwa registers a record breaking height in the fight for establishing a modern personal status law which guarantees equality among Lebanese citizens regardless of their gender or sect. The fatwa also collides with the never-ending attempts to establish a non-sectarian community, prioritizes religious dogma over affection, violates article 16 of the Universal Declaration of Human Rights2, and challenges segments b and c found in the preamble of the Lebanese constitution which states:

b. Lebanon is Arab in its identity and in its association. It is a founding and active member of the League of Arab States and abides by its pacts and covenants. Lebanon is also a founding and active member of the United Nations Organization and abides by its covenants and by the Universal Declaration of Human Rights. The Government shall embody these principles in all fields and areas without exception.
c. Lebanon is a parliamentary democratic republic based on respect for public liberties, especially the freedom of opinion and belief, and respect for social justice and equality of rights and duties among all citizens without discrimination.3

 

What Monday’s statement portrays is the institution’s fear of losing statistical count for the sectarian empire every sect has managed to establish for itself, the importance of the dollar value realized through religious marriages and divorce, and the worry of losing the lands gained from the deaths of Muslims with no heirs. More importantly, the issuing of such statement portrays the institution’s attempt to limit a certain growth in the rows of the supporting scholars by threatening those who do not conform to the institution’s terms with the highest punishment obtainable on a religious level; the “spiritual death penalty” of apostasy.

مفتي الجمهورية:كلَّ مَن يوافقُ من المسئولينَ المسلمينَ في السلطة التَشريعيةِ  والتنفيذيةِ على تشريعِ وتقنينِ الزَواجِ المدَنيّ هوَ مُرتَدٌّ وخارِجٌ عن دينِ الإسلام

بدعوة من مفتي الجمهورية اللبنانية الشيخ محمد رشيد قباني عقد في دار الفتوى اجتماع استثنائي حول موضع الزواج المدني حضره رئيس المحكمة الشرعية السنية العليا ومفتو المناطق وأميني فتوى بيروت وطرابلس وقضاة الشرع لدى المحاكم الشرعية السنية في لبنان والأمين العام للمجلس الشرعي الاسلامي الاعلى وشيوخ القراء وأئمة المساجد والخطباء ولفيف من العلماء.

وقال مفتي الجمهورية:

في تحميلِ اللهِ لكم رسالَةَ وأمانةَ الإسلام، يقولُ اللهُ تعالى في القرآنِ الكَريم: “فَلَولَا نَــفَـرَ مِن كلِّ فِرقَةٍ منهُم طائِفةٌ ليَتَفَقَّهوا في الدِّين*وَلِــيُـنذِرُوا قَومَهُم إذا رَجَعوا إليهِ لَعَلَّهُم يَحذَرُون”.

وفي وِراثَةِ العلماءِ لرسالةِ النبيِّ محمدٍ صلَّى اللهُ عليهِ وسلَّم ليَقومُوا بأَمرِ هذا الدِّين يقولُ اللهُ تعالى في القرآنِ الكَريم: “ثُمَّ أَورَثَنا الكتابَ الذينَ اصطَفَينا مِن عِبادِنا*فَمِنهُم ظالِمٌ لنَفسِهِ*وَمِنهُم مُقتَصِد*ومِنهُم سابِقٌ بالخَيراتِ بإذنِ الله”؛ فاطِر/٣٢؛والسابقُ بالخَيراتِ واللهُ أعلَم في الآيَـة همُ العُلماءُ بالله.

وإن فريضةَ الله علينا وعليكُم أيُّـها السادَةُ العلماء، تُلزِمُنا جميعاً وإيَّـاكُم، بمُواجهَةِ جميعِ المحاولاتِ الجديدةِ القديمةِ المـُـتَكرِّرة، لتَحيِيدِنا عن التَّمسُّكِ بدينِنا، وبهَديِ اللهِ تعالى لنا في القرآنِ العظيم، تحتَ عناوينَ مُنَمَّقَةٍ شتَّى، ومشاريعَ هدَّامَةٍ عِدَّة، تحتَ عناوينِ الإصلاح، فالمسلمونَ لطَالَما كانوا رُوَّاداً للمدنيةِ والحضارةِ من خلالِ دينِهم وآياتِه، ومن خلالِ حُسنِ صِلَتِهِم باللهِ تعالى رَبِّهِم، وتطبيقِ شريعتِهِ فيهِم، وإنَّ التَّصَدِّي لهذه المشاريع، التي تحاولُ استهدافَ مؤسَّساتِنا الدينيةِ اليومَ في دارِ الفتوى، بتعديل أساسِيَّاتِها، من خلالِ مشروعِ التعديلاتِ الذي يُعمَلُ لطَرحِهِ في المجلسِ الشرعيِّ اليوم ونَقِفُ لَهُ منذُ مُدَّةٍ بالمِرصاد؛ ومِن خلالِ استهدافِ أُسرَتِنا الإسلاميةِ، ومجتمعاتِنا وعلاقاتِنا الاجتماعيةِ وأحوالِنا الشخصيَّةِ مُجدَّداً بمُحاوَلةِ تَقنينِ الزواج المدَنيِّ في لبنان، كلُّ ذلِكَ، ليس خياراً لنا إسقاطُهُ فقط، بَل هو فرضُ عَينٍ على كُلِّ مسلمٍ ومسلمة مِنَّا، وهوَ وَاجبٌ ولازِمٌ على جميعِ العلماءِ المسلمينَ في لبنان مِن كل الطوائِفِ الإسلامية، وَأَن يقودوا التَّصدِّي لمُحاوَلةِ تقنينِ الزواجِ المدنيِّ، ولكُلِّ المشروعاتِ المُـدانة، فالعُلماءُ هُم قادةُ الأُمة، وهُم ورثةُ الأنبياء بِصَريحِ قَولِ النَبيِّ صلَّى اللهُ عليهِ وسلَّم، وهُم حمَلةُ أمانةِ الإسلامِ من بعدِهم؛ وفي وُجوبِ قيامِ العلماءِ بهذا الواجب، والتَّحذيرِ منَ تقصيرِهِم فيه يقولُ اللهُ تعالى في القُرآنِ الكريم:  “إنَّ الذينَ يكتُمونَ ما أَنزَلنا مِنَ البَيِّناتِ والهُدَى مِن بعدِ ما بَيَّنَّاهُ للناسِ في الكتاب*أُولَئِكَ يلعَنُهُمُ اللهُ ويلعَنُهُمُ اللاَّعِنون”؛ البقرة/١٥9؛ وليَكُن جميعُ المـُـترَبـِّــصينَ بشَرعِنا في أحوالنا الشخصيةِ اليوم، بمُحاوَلةِ زرعِ جُرثومةِ الزواج المدنيِّ في لبنان، والمترَبِّصينَ بمؤسساتِنا الدينيةِ في دار الفتوى بالتعديلات التي يُرادُ طرحُها في المجلس الشرعي، ليَكُن جميعُ المتربِّصينَ بشَرعِنا أيَّـاً كانوا، على يـقينٍ كامِل بأنَّ العلماءَ باللهِ في لبنان، لن يَــتَــوانَوا عَنِ القيامِ بواجبِـهِمُ الذي افترَضَهُ اللهُ تعالى عليهِم في كلِّ حالٍ ومَيدان، وسَيهزِمونَ بإذنِ اللهِ تعالى كلَّ محاولةٍ مِن ذلِك، فإن نصرَ اللهِ تعالى مُهَيَّأٌ في كلِّ حين، لمَنِ اعتصَمَ بحبلِهِ المـَتين وهوَ القُرآنُ العظيم، “واللهُ غالبٌ على أمرِهِ ولكنَّ أكثَرَ النَّاسِ لا يعلَمُون”، “يعلَمُونَ ظاهِراً منَ الحياةِ الدُنيا وهُم عَنِ الآخِرَةِ هُم غافِلون”.

ولذلكَ فإنني أُفتي مُستَـعيناً باللهِ العظيم: “بأنَّ كلَّ مَن يوافقُ من المسئولينَ المسلمينَ في السلطة التَشريعيةِ  والتنفيذيةِ في لبنان، على تشريعِ وتقنينِ الزَواجِ المدَنيّ، هوَ مُرتَدٌّ وخارِجٌ عن دينِ الإسلام، ولا يُغَسَّل ولا يُكَفَّنُ ولا يُصلَّى عليه، ولا يُدفَنُ في مقابِرِ المسلمين، ويحمِلُ أَوزارَ كلِّ الذينَ يدخلونَ في هذهِ العلاقةِ غيرِ المشروعة مِن أبناءِ وبناتِ المسلمينَ إلى يومِ القيامة؛ واللهُ تعالى أَعلَم، وصلَّى اللهُ تعالى وسلَّمَ على سيِّدِنا ونَبيِّنا محمدٍ وعلى آلِهِ وصَحبِهِ وسلَّمَ تسليماً كَثيراً، والحمدُ للهِ رَبِّ العالَمين.

بعد ذلك دار نقاش حول خطورة اقرار الزواج المدني الاختياري وكيفية مواجهته انطلاقا من ابقاء جلسات المجتمعين مفتوحة.
